Introduction

Khemtaw Tiffins (“Platform”) is a subscription-based food delivery service operated by Khemtaw (“we,” “us,” or “Admin”), headquartered in [City, State], India. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”) and Khemtaw, governing your access to and use of the Platform, including subscriptions, orders, payments, and interactions with other Users.

Acceptance of Terms

By registering, accessing, or using the Platform, you:

Confirm that you are at least 18 years old and legally competent to enter into a contract under Indian law.

Agree to comply with these Terms, our Privacy Policy, and all applicable laws (e.g., Consumer Protection Act, 2019; IT Act, 2000).

Consent to receive transactional notifications via WhatsApp, SMS, email, or in-app alerts.

Definitions

Credits: Virtual units purchased via subscription plans, where 1 Credit = 1 Meal.

Meal Time: Designated periods for lunch (e.g., 12:00 PM–3:00 PM) or dinner (e.g., 7:00 PM–10:00 PM).

FSSAI: Food Safety and Standards Authority of India.

Cooling-Off Period: 3-day window for Customers to request subscription refunds (if applicable).

User Registration and Eligibility

Account Creation

Users must provide accurate, complete, and updated information during registration.

Misrepresentation of identity or role (e.g., falsifying Mess Owner credentials) will result in immediate termination.

Account Security

Users are responsible for maintaining the confidentiality of their login credentials.

Notify Khemtaw immediately of unauthorized account access at support@khemtawtiffins.com.

User Roles and Responsibilities

Admin

Platform Management: Approve/reject registrations for Mess Owners and Delivery Partners.

Pricing Control: Set standardized meal prices across all messes.

Payment Handling: Process weekly payments to Mess Owners/Delivery Partners via NEFT/IMPS/RTPS, deducting a 10% service fee.

Dispute Resolution: Address complaints related to food quality, delivery, or payments within 7 working days.

Mess Owner

Menu Updates: Publish daily menus 6 hours before meal times with accurate descriptions (e.g., veg/non-veg, allergens).

Compliance: Display valid FSSAI license number on the Platform and adhere to Food Safety and Standards Act, 2006.

Order Fulfillment: Confirm order capacity and prepare meals as per Customer selections. Cancel orders only in exceptional cases (e.g., ingredient shortages).

Customer

Subscription Management: Purchase plans via the Platform. Credits are non- transferable except as per Section 9.3.

Order Deadlines: Place/cancel orders 4 hours before meal times. Late cancellations forfeit Credits.

Delivery Address: Ensure accurate address details. Khemtaw is not liable for failed deliveries due to incorrect addresses.

Delivery Partner

Order Acceptance: Confirm delivery assignments within 15 minutes of notification.

Compliance: Possess valid vehicle insurance, driving license, and adhere to traffic laws.

Delivery Standards: Maintain meal integrity (e.g., use insulated bags) and update delivery statuses in real-time.

Subscription Plans and Credit System

Plan Details

Credit Usage

Credits are non-divisible (1 Credit = 1 meal). Partial Credit usage is prohibited.

Credits expire only upon use and are valid across all registered messes.

Restrictions

Subscriptions are personalized and linked to the Customer’s account. Bulk purchases for commercial resale are prohibited.

Order Placement and Fulfillment

Order Process

Browse Menus: Customers select meals from messes registered on the Platform.

Redeem Credits: Apply Credits at checkout.

Confirmation: Mess Owners receive orders and prepare meals.

Delivery: Delivery Partners assigned via geolocation optimization.

Delivery Timelines

Meals will be delivered within 30 minutes of the designated meal time. Delays due to traffic, weather, or force majeure are excluded.

Payments and Pricing

Customer Payments

Accepted methods: UPI, Credit/Debit Cards, Net Banking, Wallets.

All prices include GST as per Indian tax laws.

Mess Owner/Delivery Partner Payouts

Weekly payments processed every Monday for the prior week’s orders.

Service fees (10%) and taxes deducted from payouts.

Disputes

Payment discrepancies must be reported within 7 days via the Platform’s “Help” section.

Cancellations, Refunds, and Transfers

Order Cancellation

By Customer: Cancel ≥4 hours before meal time for full Credit refund. Late cancellations forfeit Credits.

By Mess Owner: Only permitted for reasons like ingredient unavailability. Customers receive 2x Credits as compensation.

Subscription Refunds

Cooling-Off Period: Request refunds within 3 days of purchase for pro-rata refund (excludes used Credits and processing fees).

Post-cooling-off period, refunds processed at Khemtaw’s discretion.

Credit Transfers

Customers may transfer Credits to other Users via the Platform’s “Transfer Credits” feature.

Transfers are irreversible and subject to a 5% transfer fee.

Intellectual Property Rights

Ownership: Khemtaw retains all rights to the Platform’s logos, trademarks, software, and content.

User-Generated Content: Reviews, ratings, and feedback become Khemtaw’s property for operational improvements.

User-Generated Content and Reviews

Reviews must be truthful and comply with Indian laws. Defamatory, fraudulent, or offensive content will be removed.

Khemtaw reserves the right to moderate or delete reviews violating these Terms.

Disclaimers and Limitations of Liability

Food Safety: Mess Owners are solely liable for meal quality, hygiene, and allergen compliance.

Delivery: Khemtaw is not responsible for delays, spills, or incorrect orders caused by Delivery Partners.

Platform Availability: We do not guarantee uninterrupted access and may perform maintenance without prior notice.

Termination of Services

By Khemtaw: Accounts may be suspended/terminated for violations, fraud, or illegal activities.

By User: Customers may delete accounts via the Platform, forfeiting unused Credits unless refunded.

Dispute Resolution and Governing Law

Governing Law: These Terms are governed by Indian law, with jurisdiction in Pune, Maharashtra.

Arbitration: Disputes resolved through binding arbitration per

Privacy and Data Protection

Data collection, storage, and usage comply with India’s IT Act, 2000, and Privacy Policy.

Users consent to sharing personal details (e.g., address, phone number) with Delivery Partners for order fulfillment.

Prohibited Conduct

Users may not:

Use the Platform for unauthorized commercial purposes (e.g., reselling meals).

Harass Mess Owners, Delivery Partners, or other Users.

Reverse-engineer the Platform’s software or APIs.

Force Majeure

Khemtaw is not liable for failures due to events beyond its control, including natural disasters, pandemics, strikes, or government orders.

Amendments to Terms

Khemtaw may modify these Terms at any time. Continued use after updates constitutes acceptance.

Users will be notified of changes via email or in-app alerts.

By using Khemtaw Tiffins, you confirm that you have read, understood, and agreed to these Terms.

Khemtaw reserves the right to refuse service to any user at its discretion.
